 結婚はあくまでも(法律に規定された))一つの社会制度であり、(離婚によって経済的な不利益などを受けない)理想社会においては、子供がいない場合は、社会はそのカップルを規制する必要がない。子供ができるから弱者である子どもを守ったり、育児中の女性を保護する法律が必要がある。完全な男女平等が行き渡った社会においては、子どもがいない場合は自由恋愛が原則であり、どちらも法律でしばる必要はないはずである。もちろん、今はそういった社会にはなっていないので、法律で弱者保護の規定をいろいろしておく必要がある。
