自白は証拠とならない
カトリックの異端審問（注：正統信仰に反する教えを信じているとの容疑をかけられた者に対するカトリック教会による宗教裁判）における拷問の根底にあったものは,自白させたいという欲求であった。古代中国では,容疑者を拷問にかけるのは,習慣的なものになっていたが,それは人間性豊かなある皇帝が,いかなる者も,自白したのでなければ,有罪の判決を受けることはないと布告したからであった。警察の権力を飼いならす（おさえておだやかなものにさせる）ために必須のことは,いかなる状況においても,決して自白を証拠として採用してはならないということである。（出典：『権力論』）The desire to obtain a confession was the basis of the tortures of the Inquisition. In Old China, torture of suspected persons was habitual, because a humanitarian Emperor had decreed that no man should be condemned except on his own confession. For the taming of the power of the police, one essential is that a confession shall never, in any circumstances, be accepted as evidence.
