The enemies of the German Government would have punished with death any soldier among themselves who had practised the sort of civil disobedience the lack of which among Germans they pleaded as an excuse for condemning Germans. They refused to accept the plea made by many of those whom they condemned that they had committed criminal acts only under command of those in superior authority. The judges of Nuremberg believed that the Germans should have committed civil disobedience in the name of decency and humanity. This is little likely to have been their view if they had been judging their own countrymen and not their enemies .
