 罰として肉体的危害を加えることは,以前は,この問題について理論を述べたすべての人々によって,支持されていた。文明社会においても,300年前までは,(刑罰として)耳や舌を切落すことは,まれなことではなかった。(N. ホーソンの小説)『緋文字』で誰でも知っているように,(罪人に)焼印を押すことは,(英国植民地)ニューイングランド(米国北東部6州)では,適切なやり方であると考えられていた。(松下注:日本でも,「島流し」される人は入れ墨をいれられた。)

 概して言えば,いかなる文明の進展過程にも,必ず刑罰の苛酷さの軽減と肉体的懲罰の減少が伴っている。(参考:明治大学刑事博物館厳格な道徳家のさまざまな恐れにもかかわらず,刑法の緩和は,通例,犯罪それ自体の減少を伴った。それゆえ,統計的にも,また個々の犯罪者の心理学の問題としても,体罰を是とする根拠は存在しない。
 にもかかわらず,少くともイギリスでは,刑罰としての鞭打ち刑の復活があった。(小中学校の)'生徒時代に鞭を打たれた経験がある'大人たちは,ほとんど例外なく,それが自分のためになったと信じている。私の考えでは,この信念自体が,鞭打ちの悪しき効果の一つに他ならない。大人になってからであろうと,少年時代であろうと,この種の体罰を経験した人間は,怒りに駆られ,激烈な反逆者になるか,あるいは自分の番が来たら(自分が人を罰せられる立場になったら)他の怠け者に苦痛を与えようとする強烈な欲望を持つか,いずれかである。後者の方の感情は,道徳的怒りという名目で正当化されるが,この感情の持主は,実はこれがかつて自分がなめた同じ苦痛を他人に与えようとする欲望である事実に気がつかない。
 イギリスでは,特に憎むべきと考えられているある種の犯罪が,男性によってなされた場合,鞭打ち刑によって罰することができる。この種の犯罪に,女性の不道徳な稼ぎで生計をたてること(管理売春)や,女性に対する暴力行為(=性的暴行/レイプ)などがある。鞭打ち刑を命ずる判事は,判決を宣告する時,自分では道徳的だと思うかもしれないが,実際は'野蛮な本能の発散'であるところの,明白な喜び(の感情)を表す。『(ロンドン)タイムズ』紙に,最近,刑務所の医師が健康に重大な支障があると判断した場合には鞭打ち刑を実行してはいけないとしている現状を歎いた,ある牧師の投書が掲載された。このご立派なキリスト教の牧師は,自分が「残忍でも特別に執念深い」人間でもないことを一般読者(公衆)にしっかり言った後,「他人に暴力を加える人間は,たとえ本人の健康がどうであれ,あらゆる結果を甘受すべきである」と論じている。上院も最近,ある種の(刑事の)犯罪に関しては,少年に鞭打ち刑を科すことを可能にすることに成功したが,これは大部分の上院議員が昔学校でこうむった厳しい肉体的懲罰の自然な結果に他ならない。
 犯罪への怒りは,自然の感情であるから,厳罰が望ましいと考えるのも不思議ではない。しかしわれわれの目的が,罰を科す人々に快感を与えるだけでなく,犯罪の予防自体にあるならば,もっと科学的な態度が必要である。暴力と野蛮行為は全て,必ずその見返りの暴力と野蛮を,必ずしも直接的報復という形でなく,むしろ一般的な苛酷と残忍という形で誘発する傾向を持つ。医者が患者が病気に罹ったことを怒ったとしても,それだけ効果的な治療が可能になるわけでないのと同じく,刑法もそれが犯罪者に対する怒りに影響されたからと言って,多少とも効果的になるわけではない。犯罪人が提出する問題は,心理学的,教育学的,社会学的,経済学的なものであり,この困難な諸問題を盲目的激情の状態で取扱うのは,必ずしも最善の道ではない。肉体的懲罰を要求する一切の論証は,科学的理解からでなく,怒りから発している。人間がより一層科学的になれば,このような蛮行は,もはや黙って許される(黙認される)ことはなくなるだろう。  
The infliction of bodily injury as a punishment was formerly supported by all who theorised on the subject. In civilised communities, cutting off the ears or the tongue were not uncommon three hundred years ago. Branding was thought proper in New England, as every one knows from The Scarlet Letter. Torture to extort confession was taken for granted. It still exists, as the Wickersham Commission discovered in investigating the 'third degree', but it is now illegal, even when practised by the agents of the law. On the whole, every advance in civilisation goes with a mitigation in the severity of punishments and a diminution of physical chastisement. In spite of all the fears of the sterner moralists, gentler penal codes are usually accompanied by a lessening of crime. There is no case for corporal punishment, whether statistically or as a matter of the psychology of individual criminals.
Nevertheless, there has been, at least in England, a recrudescence of flogging as a criminal sentence. Men who, while they were schoolboys, were caned or flogged, almost invariably believe that they are the better for it. This belief itself, to my mind, is one of its bad effects. The man who, whether in adult life or in boyhood, has submitted to this sort of thing, is filled with anger, which turns him either into a furious rebel or into a man with a ferocious desire to torment other delinquents when his turn comes. The latter feeling can be justified as moral indignation, and the man who feels it never realises that it is really a desire to inflict on others what he has been made to suffer himself.

In England, certain crimes which are regarded as peculiarly odious can, when committed by men, be punished by flogging. Among such are living on the immoral earnings of women and assaults on women. The judges who order flogging display, in pronouncing sentence, an obvious pleasure, which they imagine to be virtuous but which is really a release of brutal instincts. In the London Times recently there was a letter from a clergyman regretting that this penalty cannot be inflicted when, in the opinion of the prison doctor, it is likely to do serious injury to health. This worthy Christian minister, after assuring the public that he is not 'bloodthirsty or particularly vindictive', argues that 'anyone who inflicts violence on other people should ... whatever may be the state of his own health, take the full consequences.' The House of Lords recently succeeded in making it possible to inflict flogging on boys for certain criminal offences; this is a natural consequence of the fact that most of their Lordships had suffered severe physical chastisement when they were at school.
Indignation against crime is a natural emotion and causes men to think that severe penalties are desirable. But if the object is to prevent crime, not merely to give pleasure to those who inflict punishment, a more scientific attitude is desirable. All violence and brutality tend to provoke violence and brutality in return, not necessarily in the form of direct revenge, but rather in the form of general harshness and cruelty. A physician would not cure his patients more effectually if he were angry with them for being ill, and the criminal law is not more effective when it is inspired by anger against the criminal. The criminal presents a problem, psychological, educational, sociological and economic; this difficult problem is not best handled in a state of blind rage. All arguments for corporal punishment spring from anger, not from scientific understanding. As men become more scientific, such barbaric practices will be no longer tolerated.
